Who enforces SWMS requirements in Victoria?+
WorkSafe Victoria. Victoria runs its own system under the Occupational Health and Safety Act 2004 (Vic) rather than the harmonised WHS laws, and WorkSafe inspectors enforce SWMS requirements on construction sites across the state.
Is a Victorian SWMS different from other states?+
Yes — and it matters. Victoria never signed on to the harmonised WHS framework, so the correct references are the OHS Act 2004 and OHS Regulations 2017 (Vic), not the WHS Act you'll see on documents from NSW or Queensland. When is a SWMS legally required in Victoria?+
Before any high risk construction work kicks off under the OHS Regulations 2017 (Vic) — work with a fall risk of more than 2 metres, trenches deeper than 1.5 metres, demolition, work near energised electrical installations and the rest. Prepare it first, keep it available on site, and review it if the job changes.
