Under NSW WHS law, a SWMS is required before any high-risk construction work (HRCW) begins. The principal contractor must ensure a SWMS is prepared and followed for all 19 categories of HRCW defined in the WHS Regulation 2017, Part 6.3.

Who enforces SWMS requirements in NSW?+
SafeWork NSW is the regulator. Their inspectors routinely visit construction sites across New South Wales, and one of the first things they ask for is the SWMS for any high-risk construction work. If it's missing, or it doesn't match what's actually happening on site, they can issue improvement or prohibition notices on the spot.
When do I legally need a SWMS in NSW?+
Before any high-risk construction work starts — not after. That covers work at heights with a fall risk over 2 metres, trenches deeper than 1.5 metres, demolition of load-bearing structures, work near live electrical services and the other categories set out in the WHS Regulation 2017 (NSW). The SWMS has to be prepared first, kept on site, and actually followed by the crew.
What happens if I don't have a SWMS on a NSW site?+
Significant penalties apply for carrying out high-risk construction work without one, and SafeWork NSW can also stop the job with a prohibition notice until it's sorted. Current penalty amounts are on the SafeWork NSW website. Either way, a $7.99 SWMS is a lot cheaper than a shut-down site.
Can I use a SWMS template from another state on a NSW job?+
Not properly. NSW is a harmonised WHS state, but your SWMS should reference the Work Health and Safety Act 2011 (NSW) and WHS Regulation 2017 (NSW) — not Victorian OHS law or another state's regs. What does the principal contractor need from me in NSW?+
On a construction project, the principal contractor has to obtain your SWMS before your high-risk work starts, and they're expected to check it's being followed.
